Liability & Confidentiality Agreement

Effective Date: August 1, 2026  |  Applies to all athletes, parents/guardians, staff, and participants in any program, practice, clinic, or event operated by Long Island Venom Flag Football ("the Organization").

NOTICE: By registering an athlete for a tryout, by accepting an offered roster spot through PlayMetrics, or by submitting the first commitment fee, the parent/guardian agrees to the full terms below, including the waiver of liability for injuries and the confidentiality obligations. Please read this document in its entirety before registering.

1. Agreement to These Terms

1.1 By registering an athlete to tryout for Venom, the parent/guardian acknowledges having read, understood, and agreed to this Liability & Confidentiality Agreement in its entirety.

1.2 By submitting the first commitment fee (including any deposit or initial payment), or by accepting a roster spot through PlayMetrics, the parent/guardian additionally reaffirms their agreement to this Agreement. Registration and payment constitute conclusive evidence of that agreement and do not require a separate signature.

1.3 Participation in any Organization activity — including tryouts, practices, clinics, training sessions, tournaments, and team events — constitutes continued acceptance of this Agreement for the duration of that participation.

2. Assumption of Risk

2.1 The parent/guardian acknowledges that participation in flag football and related athletic activities involves inherent risks, including without limitation: physical exertion, collisions and incidental contact with other participants, falls, strains, sprains, fractures, concussions and other head injuries, heat-related illness, and, in rare cases, serious permanent injury or death.

2.2 The parent/guardian knowingly, voluntarily, and freely assumes all such risks, both known and unknown, and accepts full responsibility for the athlete's participation.

2.3 The parent/guardian represents that the athlete is in good physical health and has no condition that would make participation unsafe, and agrees to promptly notify the Organization of any injury, medical condition, or limitation that may affect participation.

3. Waiver and Release of Liability

3.1 To the fullest extent permitted by law, the parent/guardian releases, waives, and discharges the Organization, its directors, officers, coaches, staff, volunteers, and facility owners from any and all claims, demands, or causes of action arising out of or related to the athlete's participation, including any injury, medical expense, or loss arising from participation, except in the case of gross negligence or willful misconduct.

3.2 The parent/guardian agrees not to bring or pursue any claim against the Organization, its coaches, or its staff for injuries sustained during ordinary participation in athletic activities, and agrees that disputes will first be raised directly with the Organization before any legal action is initiated.

3.3 This release applies to injuries occurring during scheduled Organization activities, including travel to and from events where the athlete is under the supervision of Organization staff.

4. Medical Treatment Authorization

4.1 The parent/guardian authorizes the Organization, its coaches, and its staff to secure emergency medical treatment for the athlete when the parent/guardian cannot be reached, including transportation by ambulance or emergency personnel if warranted.

4.2 All costs of medical care, treatment, and transportation arising from participation are the sole responsibility of the parent/guardian. The Organization does not provide medical insurance for athletes, and the parent/guardian is responsible for maintaining appropriate health insurance coverage.

4.3 The Organization is not responsible for the diagnosis, treatment, or clearance of any injury, including suspected concussions. Athletes suspected of a concussion may be held from participation until cleared, in the Organization's sole discretion.

5. Athlete Departure, Dismissal, and Absence

5.1 If an athlete voluntarily leaves the team at any point — whether before or during the season — the parent/guardian remains responsible for the full season financial obligation as described in the Refund Policy & Payment Agreement. All payments, deposits, and monthly installment balances remain due.

5.2 If an athlete is dismissed for conduct, discipline, or violation of team rules, including parent or spectator conduct, no refund, credit, or reduction of the season balance will be issued, and any remaining balance remains due in full.

5.3 If an athlete becomes unable to participate due to injury or illness, the season financial obligation remains in effect. Season expenses are divided among the selected athletes prior to the beginning of the season and do not shrink because one athlete is absent, injured, or no longer participating.

5.4 A departing athlete must return all Organization property, including uniforms, practice gear, and equipment, in the condition received, and may be billed for items not returned. Uniforms and gear remain non-refundable as set forth in the Refund Policy.

6. Coach Departures and Staffing Changes

6.1 The parent/guardian acknowledges that coaches are engaged by the Organization and that coaching assignments, rosters, and staff may change at any time before or during a season due to resignation, dismissal, availability, or other reasons.

6.2 If a coach departs — whether by resignation, removal, or otherwise — the Organization may reassign or replace the coach and continue operating the team. A coach's departure does not entitle the parent/guardian to a refund, credit, or reduction of any season fees, deposits, or monthly payments, all of which remain due under the Refund Policy & Payment Agreement.

6.3 The Organization will make reasonable efforts to maintain continuity of the team's schedule, practices, and tournament commitments following any staffing change. Coaching personnel is not a condition of the athlete's roster spot or season commitment.

6.4 Non-Solicitation. Parents/guardians and athletes agree not to solicit, recruit, or encourage Organization coaches, staff, or rostered athletes to leave the Organization or join another club, team, or organization during the season and for one (1) year thereafter.

7. Confidentiality

7.1 All proprietary materials of the Organization — including playbooks, schemes, drills, practice plans, evaluation criteria, training methods, rosters, and internal communications — are confidential and provided solely for the athlete's participation. They may not be copied, shared, forwarded, posted publicly, or provided to any third party, including other clubs, teams, or organizations, without the Organization's prior written consent.

7.2 Athlete and family information — including contact information, evaluation results, grades, medical notes, and payment status — is confidential. The Organization will not share it outside of staff and personnel with a legitimate need, except as required by law.

7.3 Photography and media. The Organization may photograph and record athletes at practices, games, and events, and may use such images and footage for promotional purposes, including the Organization's website and social media. A parent/guardian may opt out in writing by contacting the Organization.

7.4 Group messages, team chats, and internal team communications are for team use only and may not be forwarded or republished outside the team. The obligations in this Section 7 survive the end of the season and the athlete's departure.

8. Code of Conduct

8.1 Athletes, parents/guardians, and spectators are expected to conduct themselves with sportsmanship and respect toward coaches, officials, opposing teams, and one another. The Organization may suspend or dismiss any participant whose conduct it deems detrimental to the team or Organization, without refund, as set forth in Section 5.2.

The Organization reserves the right to update this Agreement; the version in effect at the time of registration governs that athlete's participation. Financial terms are additionally governed by the Refund Policy & Payment Agreement.
